Why do I need to fix accessibility violations in my code to be accessible + ADA compliant?

Most people living with disabilities will already have their own assistive technology that they use to navigate the web. These technologies rely on websites to follow the Web Content Accessibility Guidelines (WCAG) to function and if your source code is not ADA compliant, it can break these technologies, often making it harder, if not impossible, for these consumers living with disabilities to shop on your store.

Why do overlays not make you accessible or ADA compliant?

Overlay widgets use javascript to change your website based on options that users select in a pop up panel. This only affects the user's browser and doesn't actually change your source code. Imagine putting a fresh coat off paint over a rotting wall rather than changing out the wood paneling! Because of this, they are limited in the amount and types of issues they can address. Masking only 30% of issues, only makes your store 30% compliant and still liable for lawsuits for ADA violations! Not to mention, that these code injections can interfere with assistive devices used by people living with disabilities which are designed to expect the source code to comply with web standards.

Why do stores using overlays get targeted for ADA lawsuits?

There has been anecdotal evidence from merchants in the Shopify ecosystem that they are getting targeted for ADA lawsuits because they are using an overlay.
